Because of its unique location at the heart of the Willamette Valley, Evashevski Elliott PC has developed a broad base of clients involved in all aspects of the seed industry and has extensive experience and expertise in dealing with issues that are specific to the seed and agricultural industries.

Evashevski Elliott PC serves as counsel for the Oregon Seed Association (formerly the Oregon Seed Trade Association) and advised the Association during the passage of legislation in 2011 concerning grass seed grower contracts and seed dealer licensing. Attorney Helen Nelson is president-elect of the Agricultural Law Section of the Oregon State Bar.

  • Slow Pay/ No Pay issues: The Slow Pay/No Pay legislation was reviewed and revised in the 2011 legislative session, and rulemaking pursuant to the new statute is in progress as of December 2012. We are fully conversant with the new provisions and able to advise on all aspects of issues arising in relation to slow pay/ no pay.
  • Warranty, labeling, and PVP issues: We will work with our seed and agricultural clients to ensure that their warranties protect them to the extent possible; to ensure that their labeling practices are compliant with current regulations; and to ensure they have the full protection afforded to their proprietary seed varieties under the Plant Variety Protection Act.
  • Licensing and Multiplication Contracts, Royalty Contracts, Grower Contracts and other Contract Issues: Our Corvallis and Albany attorneys are available to assist our seed and agricultural clients with contract negotiating, drafting and enforcement. We have extensive experience in all areas of seed contracts including grower contracts, license agreements, and royalty agreements.
